Irregular Migrants in Europe Face Difficulties in Accessing Legal Assistance, Report Notes
GRETA’s latest general report of activities for 2023 notes that, in several countries, legal aid is not available for some categories of victims of human trafficking, such as irregular migrants.
It notes that there is a lack of lawyers specialised to represent victims of trafficking, AtoZSerwisPlus reports.
President of GRETA, Helga Gayer, has considered access to legal assistance and free legal aid essential for facilitating and guaranteeing access to justice.
The report, consisting of the publication of 11 new country evaluation reports (Azerbaijan, Estonia, Greece, Iceland, the Netherlands, North Macedonia, Poland, Serbia, Slovenia, Spain and Sweden), says that information is not given in a way that takes into consideration victims of trafficking’s situation and it is not always comprehensible to victims.
GRETA attributes this to the fact that a number of states face hurdles in ensuring access to qualified and independent interpreters for victims of trafficking.
Challenges have also been found in obtaining compensation from the perpetrators in terms of criminal or civil proceedings.
Increase in Implementation of Legislative Changes Related to Non-Punishment Provision
GRETA’s report focused mainly on the gaps related to the implementation of the Council of Europe Convention on Action against Trafficking in Human Beings on victims’ access to justice and effective measures has also revealed some of the achievements made last year by several countries.
It has noted that, on the positive side, several countries have implemented legislative changes and have issued specified guidelines related to the non-punishment provisions.
However, the independent body which monitors the way states implement the Convection has stressed that gaps in identifying victims of trafficking continue to hamper the application of the non-punishment principle.
