Lufthansa to Compensate Thousands to Indian Student After Failing to Inform Him About Transit Visa Requirements
The decision was taken by the Gandhinagar District Consumer Dispute Redressal Commission in Gujarat, India, ruling partially in favour of the student, Maharshi Yadav, who was headed on a trip from Mumbai to Toronto for the beginning of his classes, AtoZSerwisPlus reports.
The amount which Lufthansa will have to compensate Yadav is €729.29 (RS 67,612) for the tickets and around €1,078 for emotional distress.
Indian Student to Be Compensated Up to €2,000 for the Incident
Yadav was expected to board the flight in Mumbai and then stop at Munich Airport, to be later transported to Frankfurt before reaching his final destination in Toronto. However, he was stopped at Mumbai airport because he did not have a transit visa, which is mandatory for transit through European countries. This event took place in 2022.
As The Indian Express reported, Yadav made a complaint to the consumer court, claiming that the visa requirement constituted unfair trade practices. The student said that he had booked the flight in February 2022.
Due to the visa issue, he had to purchase another ticket, which was a last-minute ticket on Emirates Airlines. Through his mother, Yadav filed a complaint to the consumer court in March of 2023, seeking reimbursement of the original and replacement tickets and compensation for the emotional distress.
Lufthansa’s Late Reply to the Legal Notice – One of the Causes Why Authorities Decided in Favour of the Student
After the incident, Yadav sent a legal notice to Lufthansa, which responded to it two months later, refusing to issue a refund. The delay was one of the reasons why the court decided in favour of Yadav, due to the student’s emotional distress.
The airline has also been ordered to pay eight per cent interest on the refund amount from the complaint filing date, which was over one year ago (March of 2023). The compensation has to be paid within 30 days of receiving the certified copy of the judgment.
A Schengen transit visa is a permit granted to people from countries that do not have a visa liberalisation agreement with the EU, which is the case for India and several other countries.
This visa allows passengers to transit through the Schengen Area countries without leaving the airport and is granted for the sole purpose of changing the means of transport – which can be for airport transit or for seafarers.
