Polish Citizen Challenges Germany's Border Controls in Court
Jakub Wolinski, a 37-year-old Polish citizen, has filed a legal case against Germany over its border controls at the German-Polish border. Born in the Polish border town of Zgorzelec, Wolinski now resides in the German town of Görlitz and works for a German company, commuting regularly between the two countries.
Wolinski told Deutsche Welle that he is frequently stopped at the border, possibly because he drives a minivan with tinted windows, which often attracts scrutiny from German police looking for irregular migrants.
Border Control Incident Sparks Legal Action
Wolinski decided to take legal action after a specific incident where, during a border stop, police officers initially could not explain the legal basis for searching his vehicle. After contacting other officers, they referenced two legal paragraphs, but Wolinski remained unconvinced by their justification.
Germany’s Border Controls Face Criticism
Germany reintroduced land border controls on September 16, 2024, as part of efforts to curb irregular migration. The controls are set to remain in place until mid-March 2025, but Interior Minister Nancy Faeser has suggested they may be extended further, arguing that the measures have been effective.
However, Wolinski’s attorney, Christoph Tometten, argues that Germany is breaching European law with these controls and has called for their immediate cessation.

Poland’s Foreign Minister, Radoslaw Sikorski, criticized Germany's decision, calling it a “mistake” and suggesting that Poland is considering a response to the measure.
