Hiring a non-EU truck driver requires specific steps and documents. Here’s a guide:
Driver's Certificate ("Red Paper"): The driver's certificate, also known as the "red paper," allows the driver to transport goods across the EU. To obtain this certificate, the driver must have the following four documents:
A. Driver's Card
B. Medical Check Certificate
C. Psychological Test Confirmation
D. Code 95
Once the driver has obtained these documents, they can apply for the driver's certificate, enabling them to work as a truck driver in Poland and other EU countries.
Driver's License with CE Categories:
The first requirement is to have a valid driver's license with CE categories, which allows the driver to operate large vehicles like trucks and buses.
Driver's Card:
The driver must obtain a driver’s or a chip card. This card is inserted into the tachograph (a device that monitors the driver's working time) and records the driver's work history. The driver's card must be issued in the driver's country of origin. For instance, if the driver is from the Philippines, they should get the card issued there.
Medical Check:
All employees, including truck drivers, must undergo a standard medical examination before hiring in Poland or the EU. This examination may be specific for drivers, considering the physical and mental fitness required for the job.
Psychological Test:
A psychological test is required to ensure the driver is mentally fit and capable of safely operating a commercial vehicle, transporting goods, and handling job responsibilities.
Code 95 (Qualification Confirmation):
Code 95 confirms the driver's qualifications for the profession of a driver. To obtain Code 95, there are two scenarios:
a. If the driver's license with category C was obtained before September 2008, Code 95 can be obtained relatively quickly.
b. If the driver's license with category C were obtained after September 2, 2008, it would take more than three months to get Code 95. This can be a longer process, and some employers may prefer candidates who already have Code 95.
It's essential for both the driver and the employer to ensure that all these documents comply with the legal requirements for working as a truck driver in Poland and the broader EU. Additionally, the specific requirements and processes may vary slightly depending on the country within the EU. So, checking with local authorities or employers for country-specific details or updates is best.
