Social Security
The Act on the Social Insurance System regulates the principles of social insurance coverage and the criteria for calculating social insurance contributions. Employees are required to have pension, disability, health, and accident insurance. Depending on the type of contribution, it is funded in varying proportions by the employer and the employee. Nonetheless, it is the employer's responsibility to compute the amount of the Social Insurance Agency contribution and deduct it from the employee's pay. The employer is also responsible for timely payment of contributions to the Social Security Administration.
Healthcare and Insurances
Employees are entitled to sickness benefits, maternity benefits, an attendance allowance, compensation benefits, and a funeral allowance, as well as damages in the event of bodily injury caused by an on-the-job accident, based on their contributions to social insurance. Employees with health insurance are entitled to use public health care facilities.
Required Leave
Holidays and Annual leave
An employee is entitled to 20 or 26 days of yearly, uninterrupted, paid vacation leave, depending on how many years they have worked. Holiday vacation is awarded on days that are not working days for the employee. The holiday leave may be broken into sections based on the employee's request. However, at least one such portion of the vacation leave shall last at least 14 calendar days in this situation. The employee is entitled to the holiday leave pay that he or she would have received if he or she had been working. In addition to vacation time, the employee is entitled to time off on Sundays and public holidays. In the current calendar year, there are 13 public holidays.
Maternity and Paternity Leave
When a female employee gives birth to one child, she is entitled to 20 weeks of maternity leave, regardless of her duration of service with the company. If you have more than one child, your leave will be proportionately increased. The female employee is only allowed to take up to 6 weeks of maternity leave before the expected due date. Any of the parents may be allowed an extra 32 weeks of parental leave (for a total of 52 weeks of leave due to childbirth). In general, a parent on maternity leave will be paid 100% of his or her basic salary for the first half of the leave and 60% for the second half.
The female employee might relinquish the right to the remaining maternity leave if she has used up at least 14 weeks of it following the delivery. In this instance, the employee - the father who is raising the child – is awarded the remaining, unused maternity leave time upon his written request. In addition, the employee, who is the child's father, is entitled to a two-week paternity vacation.
Sickness and Disability Leave
While an employee is unable to work owing to illness or isolation caused by a contagious disease, the employee retains the right to 80 percent of his or her compensation for up to 33 days in a calendar year, and for an employee over 50 years of age, for up to 14 days in a calendar year. An employee retains the right to 100% of her compensation in the event of illness during pregnancy – within the above-mentioned time frame. If the employee is unable to work for a longer period of time, the Social Insurance Agency will provide illness payments.
In a calendar year, a person with a severe or moderate handicap is entitled to an additional 10 working days of vacation time. After working for one year and being classed in one of the aforementioned degrees of handicap, the person is granted the right.
Other Required or Typically Provided Leave(s)
The employer is obliged to release an employee from work for a period of:
- 2 days – in the case of the employee’s wedding, birth of a child, or death and funeral of his/her spouse or child, father, mother, stepfather or stepmother;
- 1 day – in the case of the employee’s child’s wedding or death and funeral of the employee’s sister, brother, mother-in-law, father-in-law, grandmother, grandfather and other individuals maintained by the employee or under his/her direct care.
There are other special-case leaves as well, such as leave in order to donate blood or plasma, or leave for persons summoned to appear before a court or administrative body.
Pensions: Mandatory and Typically Provided
The present Polish pension system is divided into three sections, known as the pillars. The funds are managed by the Social Insurance Agency in the first pillar. Although the funds are recorded on the insured person's individual account and are subject to valorisation, they are not invested. The second pillar is based on the activities of Open Pension Funds, which are charged with trading and multiplying the fund. Employee Pension Schemes and Individual Retirement Accounts make up the third pillar. The first and second are required, but participation in the third is optional.
The sum of valorized contributions recorded on an individual account of the insured at the Social Insurance Agency, the valorized initial capital, and an average lifetime for women and men are used to determine the first pillar pension. The amount of the pension under the second and third pillars is determined by the funds' investing effectiveness.
At the moment, the retirement age for women is 60 and for men it is 65. Only after reaching this age is it possible to apply for a pension. Bridge retirement pensions for people working in unusual circumstances or performing unusual jobs are the only exceptions. At the age of 55 for women and 60 for males, such people are entitled to pension benefits.
