Foreigners find it easier to change jobs in Poland
Even the ruling party in Poland knows that there will soon be a real breakdown (if it has not yet happened) in the operation of the Foreign Office.
Power? Bossernaker, Secretary of State of the Ministry of the Interior and Administration, is responsible for the production of new changes to the Foreigners Act. It can also be said, with almost 100 percent confidence, that by the end of 2020 everybody will be on their own.
What are foreigners waiting for?
The first and most important issue is to simplify the process for securing job and residency permits (residence cards in Poland). In particular:
- no requirement to have a guaranteed place of residence and a source of permanent and regular income in order to obtain a permit for temporary residence and work in favor of the minimum wage requirement;
- it will be possible to change job and employer without changing the residence card;
- change in the number of fees for the exchange or reissue of documents;
- extension of the categories of workers who will be able to change jobs freely without having to submit a new application for a residence permit;
- simplification of family reunification procedures;
- simplification of the process of obtaining a temporary residence and work permit for foreigners who will work in industries strategically important for the Polish economy.
Moreover, it is planned to shorten the processing time for applications for temporary residence and work to 60 days (in the case of a complete application). It is expected that the appeal will take 90 days to be processed. Story? Possible, but not for everyone.
Those who receive a negative decision will not be delighted. The draft act provides for the abolition of the provisions extending the period of leaving the territory of the Republic of Poland, as well as the period of voluntary return specified in decisions on forced return of a foreigner. The personal presence of foreigners while submitting the applications will be voluntary. However, applications for temporary residence submitted before March 14, 2020, will be considered under an accelerated and simplified procedure.
Surprisingly, however, the draft provides for changes in the document circulation procedure between the voivodeship and the services providing information about foreigners. Now the circulation of documents can be done in electronic form. A lot of progress!
From the above, we can draw one conclusion: for those who came to Poland legally to work, it will be much easier and easier to obtain a residence card in Poland. So much for the topic ... For those who want to consciously stay after a negative decision, these changes will not do any good.
