What is work permit type A in Poland?
A type A permit is issued to a foreigner working in the territory of Poland, on the basis of an agreement with an entity (employer) whose seat, place of residence or branch, plant or other form of organized activity is located in Poland.
Conditions for obtaining a type A permit
- the amount of remuneration, which will be specified in the contract with the foreigner, may not be lower than the remuneration of employees performing work of a comparable type or in a comparable position
- the amount of the foreigner's monthly remuneration may not be lower than the amount of the minimum remuneration for work
- the employer must have a certificate from the supervisor that it is impossible to meet the employer's staffing needs based on the registers of the unemployed and jobseekers
For how long are type A permits issued
A type A work permit is always issued for a specified period, not longer than three years. Authorizations may be renewed. The employer must submit an Application for the permit extension no earlier than 90 and no later than 30 days before the permit expiry. The voivode may shorten the period for which type A work permits are issued in a given voivodeship. The work permit's validity length may vary depending on where it was issued.
How long does it take for an A permit to receive it
There is no specific application deadline, but the procedure for issuing a work permit may take up to six months. Remember that these deadlines are counted from the date of submitting a complete and formally correct application.

- Voivode competent for your seat or place of residence
- Mazowieckie Voivode, when the specificity of the foreigner's work does not allow for the indication of the principal place of its performance
The costs of applying for a type A work permit
- 50 PLN – fee for issuing a license for up to 3 months.
- 100PLN – fee for issuing a permit for more than three months.
The fee should be paid to the account of the voivodeship office to which the Application is submitted.

What is a type A work permit, and what possibilities does it offer?
Type A work permit is a document issued by the Voivode's Office (relevant for the employer's seat) on which a foreigner can apply for a visa or extend legal work in Poland. The Application for a permit is submitted by an employer who intends to employ a foreign employee. The employer is also obliged to pay the fee for the work permit for the foreigner. A type A work permit is issued for not longer than three years and can be extended after that time.

Labour market test
The first step to be taken by an employer who decides to employ a foreigner based on a type A work permit is to obtain information from the starost office (relevant for the foreigner's future place of work) on the lack of possibility to meet the staffing needs based on the registers of unemployed persons and job seekers or the negative result of recruitment organized for the employer. In other words, it is necessary to verify the local labour market and the availability of candidates for the position being offered. The starost's opinion is valid for six months. An exception is when an employee is exempt from such an obligation and already has a relevant document issued by the starost.
Fee for the work permit for a foreigner
Depending on the planned length of employment of a foreigner, before applying, the employer should pay a fee for the work permit for a foreigner onto the bank account indicated by the Voivode's Office. The payment amounts to PLN 50 for permits issued for up to 3 months and PLN 100 for permits issued for longer than three months.
Necessary documents
The employer who already has the opinion of the starost and has made the necessary payment, for which he has proof of payment, has to prepare other documents needed for issuing a work permit for a foreigner in Poland. To avoid formal deficiencies and the resulting prolongation of the procedure of processing the Application, it is advisable also to enclose copies of all non-blank pages in the foreigner's passport, a statement on the employer's clean criminal record, the company's articles of association or notary deeds of incorporation, the original power of attorney or authorization if the employer does not submit the documents in person.
Submission of the Application to the Voivode's Office
The employer must submit the Application for a foreigner's work permit and all attachments to the Voivode's Office. The Application must be signed by the person authorized to represent the company. It is worth remembering that the work permit is issued for a specific employer or foreigner and only for work performed in a particular place and position. A change of employer or employment conditions (primarily the position) requires starting the procedure from the beginning.
When should you apply for a type A work permit?
As a rule, the voivode's office has 30 days to consider the application application decision. However, one should consider the time necessary to deliver the obtained permit to the foreigner (it is often a matter of sending the document abroad) and the time needed by the employee to apply for a visa.
